These Terms of Service (“Terms”) form a legally binding contract between you and Project Evelyn (“we,” “us,” or “our”). By installing, accessing, or using the Project Evelyn watchOS app, iOS companion app, website, or related services (“Service”), you agree to these Terms and to our Privacy Policy. The Service is available globally across all regions supported by the Apple App Store, and you are responsible for compliance with any local laws applicable in your jurisdiction.
1. Eligibility
You must be at least 13 years old (or the minimum age in your country) and able to form a binding contract to use the Service.
2. Accounts and Subscriptions
Creating an account or authenticating your device may be required. Keep your credentials secure.
The Service offers premium features through auto-renewing subscriptions billed through your Apple App Store account (StoreKit). Prices may change on renewal with prior notice.
Subscriptions renew automatically until cancelled in your Apple ID Account Settings. Access continues until the end of the paid term. Payments are non-refundable except where required by law.
If you are in the EU/UK, you acknowledge that digital delivery begins immediately and you waive your 14-day withdrawal right upon purchase.
3. License Grant and Restrictions
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service and any content or results it generates on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in Apple’s Media Services Terms and Conditions and Apple's Standard Licensed Application End User License Agreement (“Standard EULA”). These Terms supplement, and do not override, the mandatory minimum terms of Apple's Standard EULA.
You must not:
- Use the Service except for lawful purposes.
- Reverse-engineer, decompile, disassemble, or scrape the Service or server endpoints.
- Resell, rent, or lease access to the Service.
- Bypass rate limits, device checks, or server security mechanisms.
- Upload unlawful, harmful, or malicious content.
- Use the Service in violation of export-control or sanctions laws.
4. User Content and AI Results
You own the search queries, messages, and content you create. You give Project Evelyn a limited license to store, process, and back up that content to deliver the Service. AI-generated results are supplied "as is"; you should independently verify critical information before relying on it.
5. Feedback
Suggestions or bug reports you send may be used by Project Evelyn without obligation or compensation to you.
6. Promotions
If we run a contest or promotion, separate rules will apply. Participation constitutes acceptance of those rules.
7. Updates and Service Changes
We may add, change, or remove features or discontinue the Service at any time. We will give advance notice of any major change when practical.
8. Intellectual Property
All Project Evelyn trademarks, logos, branding, and non-user content are owned by Project Evelyn. Except for the limited license above, no rights are granted.
9. DMCA & Copyright Notice
If you believe content on the Service infringes your copyright, send a takedown notice via our contact page or directly to support@projectevelyn.com. We may remove material and terminate repeat infringers.
10. Disclaimers
The Service and all generated output are provided “as is” and “as available.” Project Evelyn makes no warranty of accuracy, security, reliability, or fitness for a particular purpose.
11. Limitation of Liability
Project Evelyn is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability will not exceed the amount you paid us in the twelve months preceding the claim.
12. Indemnification
You will indemnify and hold harmless Project Evelyn from claims and losses arising from your content, your queries, or your breach of these Terms.
13. Export Compliance
You may not use the Service if you are subject to U.S. sanctions or located in an embargoed country.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access for breach or if we discontinue the Service. Sections 4, 8, and 10 through 18 survive termination.
15. Force Majeure
Project Evelyn is not liable for failure to perform due to events beyond reasonable control, including internet outages, natural disasters, or regulatory actions.
16. Governing Law and Dispute Resolution
These Terms are governed by California law (USA) without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in San Francisco County, California. You waive class-action rights.
17. Severability and Waiver
If any term is found unenforceable, the remaining terms remain in force. Failure to enforce a provision is not a waiver.
18. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Project Evelyn regarding the Service and replace any prior agreements.
